Is my foreign divorce recognised in the Netherlands?

You got divorced abroad and have since moved to the Netherlands. Everything may seem settled, but what happens if you want to remarry, update official records or deal with another legal matter? An important question may arise: is your foreign divorce recognised in the Netherlands?

Recognition of a foreign divorce

In most cases, the answer is yes.

Divorces granted in EU Member States are generally recognised in the Netherlands. European regulations provide a framework for the mutual recognition of family law judgments throughout the European Union.

Divorces granted outside the EU are often recognised as well. However, certain conditions must be met. One of the key requirements is that the divorce proceedings complied with fundamental principles of due process and fairness. For example, the Dutch authorities may assess whether both parties had a proper opportunity to be heard and whether the divorce was granted by a court or authority with (international) jurisdiction.

Ancillary orders (such as children and maintenance)

It is important to note that recognition of a foreign divorce does not automatically mean that all related decisions will also be recognised in the Netherlands.

Issues concerning children, child support, spousal maintenance or other ancillary matters are subject to different recognition rules. As a result, the divorce itself may be recognised, while questions relating to other parts of the judgment require a separate assessment.

Recognition abroad of a Dutch divorce

The reverse situation raises a different question: will a Dutch divorce be recognised in another country?

Within the European Union, recognition is generally straightforward. A special European certificate can be issued by the Dutch court, allowing the divorce to be recognised in another EU Member State without the need for separate court proceedings.

Outside the EU, recognition depends on the laws and procedures of the country where recognition is sought. Some countries, for example, require an apostille on the Dutch divorce decree before recognising the divorce.

It is also important to be aware that not all countries recognise the termination of a registered partnership concluded abroad, or marriages and registered partnerships involving same-sex couples. This may affect the legal status of the parties in the country concerned.
